Title: Question -- dilemma -- seller doesn't come through
Post by: phubaiblues on June 29, 2011, 06:30 am
Say I make this buy: a reputable seller.  My account says 'in transit'...goods don't show.  After a week, still nothing.  I pm him.  He says it didn't come through for a bunch of us, sorry.  He suggests I 'finalize' sale, so he can replace btc.

Now, what recourse do I have?  If I do as he suggests, and finalize sale, then if he *doesn't* send me the btc, I'm SOL, right?  I know at this point I can't 'cancel' sale...can he on his end?

To me, the way I look at it, he either sends the btc to my account, and *then* I finalize, and say nice things about how he handled a bad situation...or I wait out until times up--21 days, I think--and then file complaint...and of course, then I'd probably post some negative feedback.  BTC are in escrow, and I get them back.

I like the guy, I think he's legit, he's got good rep.  It's just this particular drug is kind of known to cause...well, in my experience, a lot of crazy eithical shit can happen around this deal: you can be selling it one day, and stealing your mom's t.v. set the next to replace it...so I don't know...

And of course, if he *doesn't* send the btc or cancel order, then I feel I owe it to the others on here to post a thread on him.  And I want to give him a way not to trash his rep.  He's pulled all sales, so for right now he's not selling...

What should I do?...wait it out, is my guess.  For me to 'finalize' would be putting myself in a 'trick bag,' as if then he *didn't* send me the btc, I"d feel like an idiot for being a fool twice.  And also, once I finalize, that's my opportunity/time to post feedback, and I need to give him the chance to fix this...

I always advise against finalizing yourself with a vendor, unless you really feel secure with your vendor and have dealt with him on many occasions. Check to see what his most recent feedback reads, if yours got lost maybe others in the same batch did too. Are they getting their btc back.

But when dealing with esp. sketchy and addictive drugs(Coke,Heroin,Meth), I would never finalize an order that didnt arrive. Ask the vendor to refund btc from his pocket first and then you'll finalize, I mean you fronted up the btc in the first place.

Your only other recourse is to take the order to resolution.

If both parties agree can the process be sped up?

I'm in the same position, so I know which vendor to which you're referring.  It sucks because his transactions have always ended on a positive note, usually with product showing up but if not refunds being given.  If I'd had a lot of successful transactions with this person in the past, I'd trust him.  Fact is, this is my first order with him, so I'm not finalizing anything until my order shows up, unless he sends me my BTC.  In that way, he'd be paying for positive feedback, in a sense, which he'd deserve if he is honest and gives back the BTC.  I think the guy is legit.  I think he tried to mail out way too much stuff at one time and it all got swiped.  It is too bad, because he was sending a very rare kind of thing that I had been searching for for quite some time.  Maybe this will all blow over and he'll pop back up with a new shipping method.  Surely he has to be making a mint off of those things, and he's had way to many successful transactions.  Nobody is going to trash his rep if he makes good, either with a refund or reship.  Of course, he might get ripped off if people jump on the "I didn't get mine" bandwagon.

Yeah. My gut feeling is it went sour.  *How* it went sour, I could spend pages on, as this drug can--and has--made me myself do things that I cannot defend at all...to people who trusted me...it's that powerful...so I get *that*, no sweat.  It also is prone to being ripped, as he suggests...I know people would have been camped out for weeks, watching, for a prize like this...junkies are real  good at sizing up situations quickly, and I've known plenty who'd have picked up on this one fast, not batted an eye, and kept a close watch on the mailbox...maybe he told his old lady, she told her best friend, she told her boyfriend, the pimp ... etc...

But I don't want to be chickenshit, either, and down the line, if this happens again, say: "Oh that happened to me too, a while ago, but I didn't want to say anything because I truseted the seller..."  I owe people on here the truth also, so they can make up their own minds.

My cynical guess, based on experience, is that he meant well, planned to do it right,(as he'd been doing), but probably uses his own product, ran *out*, started getting sick, and did what most of us would have done, and now is trying to clean it up, best he can.  Good heart + Bad habit = ?

It's not a rip, just an inconvenience...and par for the course, with this deal in particular...I'd do the the same thing all over again...truth be told...

I guess I don't see why you can't just initiate a resolution for a full refund and have the seller accept. Then you get your BTC instantly and you can still give them a positive rating.
